European code approval procedure

Where a draft code of conduct relates to processing activities in several European Economic Area Member States, the President of the Personal Data Protection Office shall submit the draft code to the European Data Protection Board which shall provide an opinion on whether the draft code complies with the Regulation. Then the European Data Protection Board shall submit its opinion to the European Commission, which may decide that the code of conduct has general validity within the Union. Therefore, it is so important at the drafting stage of the code that the code authors establish whether its provisions will relate to processing operations only in Poland or also in other EU member states.
